BIRMINGHAM (AL)–After a three-day court trial, Jennifer Egbe, Will Thompson, and the City of Birmingham won a defense verdict in the Circuit Court of Jefferson County Alabama on June 29, 2023. In this case, there were allegations that a traffic signal was defective or malfunctioning. The plaintiff was injured in a two vehicle accident in Ensley (Alabama) and sued the City of Birmingham as well as the driver who struck her.
In her complaint, the Plaintiff claimed that Ensley’s City had negligently neglected to maintain traffic signals at a particular intersection. Plaintiff claimed that the alleged defect or malfunction caused two green traffic lights to conflict and a collision between Plaintiff and her striking driver. The City was able to successfully refute a presumption that it had been negligent in maintaining the traffic signal and presented evidence proving the signal did not malfunction or be defective at the time the accident occurred. After a three-day court trial, the jury unanimously decided that the signal had not been negligently maintained and was not defective. The verdict went to the City of Birmingham.
