The REAL ID Full Enforcement Deadline Extension
Earlier this month, the U.S. Department of Homeland Security (DHS) announced its intent to extend the REAL ID full enforcement date by 24 months, from May 3, 2023 to May 7, 2025. This is not the first time that the REAL ID deadline has been extended. The REAL ID deadline was first extended from October 1, 2020 to October 1, 2021 due to the COVID-19 pandemic. According to the DHS press release:
- The extension is necessary, in part, to address the lingering impacts of the COVID-19 pandemic on the ability to obtain a REAL ID driver’s license or identification card. REAL ID progress over the past two years has been significantly hindered by state driver’s licensing agencies having to work through the backlogs created by the pandemic. Many of these agencies took various steps in response to the pandemic including automatically extending the expiration dates of driver’s licenses and identification cards and shifting operations to appointment only.
In the press release, Secretary of Homeland Security Alejandro N. Mayorkas explained, “DHS continues to work closely with U.S. states, the District of Columbia, and the U.S. territories to meet REAL ID requirements.”
Mayorkas continued, “This extension will give states needed time to ensure their residents can obtain a REAL ID-compliant license or identification card. DHS will also use this time to implement innovations to make the process more efficient and accessible. We will continue to ensure that the American public can travel safely.”
What Is the REAL ID?
The REAL ID comes from the REAL ID Act, which Congress passed in 2005. The text for the REAL ID Act can be found in Emergency Supplemental Appropriations Act for Defense, the Global War on Terror, and Tsunami Relief, 2005, P.L. 109-13, §§ 201-207, 119 Stat. 231, 312-16 (2005).
According to DHS, the REAL ID Act:
- Established minimum security standards for state-issued driver’s licenses and identification cards and prohibits certain federal agencies from accepting for official purposes licenses and identification cards from states that do not meet these standards.
The purposes include the following:
- Accessing certain federal facilities
- Boarding federally regulated commercial aircraft
- Entering nuclear power plants
What Happens on May 7, 2025?
According to DHS, when the REAL ID enforcement date begins:
- Federal agencies, including DHS and TSA, may only accept state-issued driver’s licenses and identification cards as identification for purposes of accessing federal facilities – including TSA airport security checkpoints – if the license or card was issued by a REAL ID compliant state in accordance with the REAL ID security standards (meaning the license or card must include the REAL ID compliant star marking).
