Plaintiffs Sarah Andersen and Kelly McKernan, along with Karla Ortiz, allege that Stability AI’s Stable Diffusion tool, which Stability AI and DeviantArt all use in the automated generation images, was trained on billions upon billions of copyright protected images that were’scrapped’ from the internet.
According to the suit, these images were downloaded by the companies to be used to create the AI “without compensation” or consent from the artists. The group is seeking unspecified damages and a jury trial.
A spokesperson for Stability AI stated that they take these matters very seriously. “Anyone who believes this isn’t fair use doesn’t understand the technology or misunderstands law.”
Getty images is also suing Stability AI. They claim that the company downloaded millions of their images and used them for AI training, without the appropriate licensing.
