Triwo AG was advised by Dr Gerrit Srotmann of Konig Rechtsanwalte.
Dr Jan Markus Plathner was the insolvency administrator for this estate. He is a partner at Brinkmann and Partner. His partner colleague Christoph Enkler also served as an insolvency agent. A team headed by Dr Hendrik BOSS, Taylor Wessing in Munich, advised the insolvency estate.
Dr Oliver Lorenz of MTJZ Frankfurt acted as notary public for the notarisation, and other notarial transaction involved, from the start of the process.
Hahn Airport, a former US airbase, has been used by civilians for 30 years. It is now the only major commercial Airport in Rhineland-Palatinate. The new owner will take on all of the airport staff, which is approximately 400 people. Flight operations will continue.
The purchase brings an end to a long-running impasse that has continued ever since the bankruptcy of the airport in 2021. It is the future of this important piece of infrastructure for transport at stake. After the bankruptcy, the Hahn Airport in Frankfurt was sold by the Swift Conjoy group of investors at the end June 2022. At that time, the asset was purchased in a bidding process involving “bidder showdown” until just before Dr Lorenz notarised in Frankfurt. Swift Conjoy did not pay the purchase price.
After Swift Conjoy defaulted, the second- and third-highest bidders executed notarised purchase contracts and transferred the sum of the purchase to a notarial account. They did this without obtaining the permission of the creditors or a license to operate. Triwo’s purchase agreement was approved unanimously by creditors.
