McGowan (Jon), a Florida attorney, for The McGowan Law Firm. “The Trouble with Tibble: Environmental, Society, and Governance (ESG and Fiduciary Responsibility)” examined the complicated relationship between ESG’s rise and the fiduciary obligation of corporate directors and fund managers.
ESG investing is rapidly developing and moving faster than existing regulatory systems. McGowan’s article examines the history of ESG and legal developments in the United States. It also discusses the problems ESG can cause for corporate directors and fund managers who must meet unclear ESG standards and fulfill their fiduciary duties. McGowan examined the current fiduciary standards in America and concluded that ESG investment may be a breach by directors or managers who trade profits to meet ESG standards.
McGowan is a recognized expert in ESG legal development. McGowan authored a chapter about ESG in the United Kingdom, which was published by ABA Publishing. He wrote a journal article about green bonds in the United Kingdom, for The Year In Review. It was published by The International Law Journal of American Bar Association/ International Law Section. He spoke on November 17th at the International Conference on European Company Law and Corporate Governance, Croatia on ESG and fiduciary duties in the European Union. He is a Fellow of the European Law Institute and a member of the consultative committee for Guidance on Company Capital, Financial Accounting for Corporate Sustainability.
