Kraft Heinz Faces Court Battle Over Misleading Mac & Cheese Label Claims.

Kraft Heinz faces a federal court battle after a judge allowed a class action lawsuit to proceed, accusing the company of misleading consumers about its Mac & Cheese being free of artificial flavors, preservatives, and dyes. The lawsuit, filed in December 2023, includes plaintiffs from Illinois, California, and New York.

 

The Allegations: Misleading Labeling of Kraft Mac & Cheese

Kraft Heinz’s claim that its Mac & Cheese contains “No Artificial Flavors, Preservatives, or Dyes.” However, the plaintiffs argue that certain ingredients in the product are, in fact, artificial and should not be considered “natural” by consumers. Specifically, the lawsuit points to the presence of synthetic citric acid and sodium phosphates as key ingredients that contradict the company’s labeling claims.

In her ruling, U.S. District Judge Mary M. Rowland agreed with the plaintiffs, stating that they had sufficiently alleged that these ingredients are indeed artificial. According to the memorandum, this finding bolstered the consumers’ argument that the product’s label is misleading. Rowland’s decision marks a significant moment in the legal battle, as it allows the class action lawsuit to move forward.

Kraft Heinz’s Attempt to Dismiss the Lawsuit

Kraft Heinz initially sought to have the case dismissed, claiming that the plaintiffs did not provide enough factual evidence to prove that artificial preservatives were used in the product. The company argued that since the plaintiffs could not definitively show the inclusion of artificial preservatives, they failed to state a valid legal claim.

However, Judge Rowland rejected Kraft’s dismissal request, siding with the consumers who argued that the presence of artificial ingredients—like citric acid and sodium phosphates—undermines the company’s marketing claims. This ruling is a critical step in advancing the class action lawsuit, which could result in significant financial and reputational consequences for the food giant if the plaintiffs prevail.

No Requirement for Label Changes, For Now

While the judge ruled in favor of the plaintiffs on the core issue of the misleading labeling, Rowland did not agree with the plaintiffs’ request to force Kraft Heinz to change the product’s labels. The ruling noted that the consumers had already shown awareness of the potentially artificial ingredients in the product, which could protect them from future harm. Therefore, the court did not see the need for Kraft Heinz to modify its labeling at this stage.
