CHARLOTTE (N.C.–Moore & Van Allen PLLC) (MVA), has been named a Global Competition Review (GCR), 2023 “Behavioural Matter of the Year – Americas” winner. MVA was awarded along with other defense companies for securing complete acquittals during a highly publicized U.S. Department of Justice criminal antitrust prosecution of chicken industry executives.

The Behavioural matter of the Year – Americas award recognizes “creative and strategic work” in civil or criminal proceedings against antitrust enforcement officials. These awards were presented on March 28th in Washington, D.C. at the 13th Annual Awards Event of GCR.

MVA represented retired Pilgrim’s Pride Corporation CEO Bill Lovette in U.S.V. Penn, and others, in a case that involved three separate trials. The DOJ’s accusations of a multiyear conspiracy to rig prices and fix bids in the national broiler poultry market violated the Sherman Act. Both the first and second trials were abandoned by the jury, which failed to reach a verdict for any of the ten defendants. The DOJ proceeded with a third trial against five of the smaller defendants, including Mr. Lovette. The jury found Mr. Lovette, along with the other defendants, not guilty after more than a month. This was thanks to MVA’s aggressive, fact-based defence case, which included complex economic expert testimony.

Apart from Mr. Fagg the MVA team that represented Mr. Lovette also included partners Frank E. Schall, James P. McLoughlin Jr. and Katherine Clarke McDiarmid, Fielding E. Huseth and Alexis T. Narducci.
