MIAMI (FL)–Recently, a D.C. A circuit panel upheld a ruling by a lower court ordering Moldova to pay $42.6 million to an arbitration award to a Ukrainian company. The lower court had incorrectly refused to stop enforcement of the award in spite of ongoing litigation in Europe.

Background: The proceedings started in 2010, when Moldova was accused of failing to pay its Energoalliance energy bills. Stileks then acquired the claim against Moldova, and sought to have it repaid through arbitration under the Energy Charter Treaty (“ECT”) In Paris, an arbitration tribunal found that Moldova had violated the ECT’s obligations and awarded Stileks damages.
