Extraordinary Immigration means that you have to meet the relevant criteria in order to be eligible for an EB-1 visa. Your extraordinary abilities and merit to be granted your EB-1 Visa are the main criteria.


Imagine that you have achieved extraordinary success in your chosen field and want to move to the U.S. to further your achievements. The following information may be useful in your quest to obtain an EB-1 Visa.


EB-1A Extraordinary Ability


You must show that you have extraordinary abilities in arts, education, or business by proving national or international acclaim to be eligible for an EB-1A Visa. This visa type has ten eligibility requirements, but you only need to meet three. No matter what your field of work, you must have held leading positions in a prestigious organization and earned a higher salary that your coworkers.

You must also prove that your contribution to original scientific, artistic, or scholarly work was significant and that it had an impact on your field. If you are a recipient of an Academy Award, a Pulitzer Prize or an Olympic Medal, then you may be eligible for the EB-1A Visa for Extraordinary Ability. You must complete Form I-140, Petition to Alien Worker, in order to apply for this visa.


EB-1B Outstanding Professors and Research


Two of the six requirements must be met to obtain an EB-1B Visa. Let’s say you can show that you are an international scholar with outstanding achievements in your field.


You may also be eligible to apply for the EB-1B Visa in this case. You must be a member of prestigious associations, or have original scientific research and scholarly works before you apply for the EB-1B Visa. Another criterion to prove your eligibility for an EB-1B Visa is publication of material in professional publications. Authorship of scholarly books in your field is also a requirement.


Fill out the Form I-140 to prove that your reason for coming to the U.S. to study at a university or other higher education institution. An annual report, federal income tax returns, or audited financial statements must be submitted to prove that your wages can be paid.


EB-1C: Certain Multinational Managers and Executive


You must prove that you have a qualifying relationship to the business or company entity with which you have worked for at least one calendar year. You must be provided with evidence that the company intends to hire you as a manager or executive. You must fill out Form I-140, Petition For Alien Worker and show that your employer is able to pay your wages for a long period of time.
